Notas sobre o caldo de cultura que permeia os atuais embates no campo indigenista

Abstract

Unlike neighboring countries whose constitutions define their multicultural and multiethnic statutes, the indigenous rights inscribed on Brazilian Constitution are primarily defined by the recognition of territorial occupation. At this moment when the political struggles brings into question the validity of these rights, the text aims to discuss the extent of its application since enactment of the Brazilian Constitution

À diferença de países vizinhos, cujas constituições definem seus estatutos multicultural e pluriétnico, no Brasil os direitos constitucionais indígenas inscrevem-se primordialmente pelo reconhecimento da ocupação territorial. No presente momento, em que embates políticos colocam em questão a vigência destes direitos, o texto faz uma avaliação do alcance de sua aplicação desde a promulgação da Constituição brasileira.
